Another great victory for Woods!

In the matter of Télévision communautaire et indépendante de Montréal (TVCI-MTL) v. Vidéotron s.e.n.c., Woods succeeded once more in obtaining the dismissal of an application for authorization to institute a class action against its client, Vidéotron. This application aimed at sanctioning failures to comply with the Broadcasting Distribution Regulations in the field of community television.

Based on the arguments presented by our firm, the Superior Court decided that it lacked jurisdiction to rule over the significant majority of the alleged breaches, since the C.R.T.C. had the sole jurisdiction under the Broadcasting Act. As for the remaining breaches, the Superior Court decided it had jurisdiction to rule over the faults alleged against Vidéotron, however, it nevertheless decided to dismiss the application for authorization on the grounds that the plaintiff was not a proper representative, given that its personal interests differed from those of the members of the class it sought to represent.
